BOARD MEETING MINUTES
Special Meeting of the Board – March 14, 2017
BOARD MEMBERS PRESENT: Dave Young, Mike Dobson, Gretchen Stubenvol, Chan Pollock (by phone), Scott Smith, Eric Helander, Leanne Fessenmeyer
OTHER HOA MEMBERS PRESENT: Fabrice Fonck
Background: A homeowner had submitted a request to the Architectural Review Committee for the installation of a solar panel system. Preliminary design documents were submitted along with various documents that referred to Colorado statute regarding homeowner and HOA requirements. The current covenants and architectural requirements for the HOA do not specifically cover solar systems and the ARC requested a special meeting of the Board to discuss the request.
A quorum constituting the required board members were present in person. The meeting was called to order at 7:00 pm on March 14, 2017 at the residence of Dave Young.
Leanne reviewed the background, summarized above. The Board also reviewed the Colorado statutes and legal “blogs” available on the subject. After some discussion, the Board decided on the following actions:
- The formation of a small subcommittee, headed by Chan and including Board members Gretchen and Leanne, tasked to reach out to the HOA attorney to ensure that a.) our covenants are aligned with Colorado statue regarding alternative energy requests, and b.) guidance regarding how to manage requests such as the one discussed at this meeting.
- The approval of a small budget not to exceed $1,000 for the legal guidance
The Board developed an initial list of guidelines regarding appearance, placement, size and maintenance for discussion with the attorney regarding how to incorporate into our ARC review processes.
Chan agreed to make the initial contact with the attorney and would attempt to schedule the first call with the subcommittee for Friday March 17, 2017.
The actions were unanimously approved.
The meeting was adjourned at 8:00 pm.
